These Terms & Conditions ("Terms") govern your access to and use of the BarStreamHub platform ("Platform", "Service"), operated by Meridian Global Holdings Limited ("Company", "we", "us", "our"), a company duly incorporated under the laws of the Hong Kong Special Administrative Region of the People's Republic of China, with Business Registration No. 79918915 and registered address at Unit 1603, 16th Floor, The L. Plaza, 367–375 Queen's Road Central, Sheung Wan, Hong Kong.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform. Your use of the Platform constitutes your acknowledgement that you have read, understood, and accepted these Terms in their entirety.
These Terms apply to all users of the Platform, including venue owners ("Tenants"), performers ("Performers"), and viewers ("Viewers"). Tenants who operate their establishments in Thailand or serve viewers located in Thailand are subject to the laws of the Kingdom of Thailand, including but not limited to the Computer Crime Act B.E. 2550 (2007) (as amended) ("CCA") and the Personal Data Protection Act B.E. 2562 (2019) ("PDPA").
Definitions
1.1 "Tenant" means a bar, nightclub, entertainment venue, or any other commercial establishment that registers on the Platform to use the Services, whether operating in Thailand, Hong Kong, or any other jurisdiction.
1.2 "Bar Admin" means the natural person designated by a Tenant to manage the Tenant's account and perform administrative functions on the Platform.
1.3 "Performer" means any individual who broadcasts live Content through the Platform on behalf of a Tenant. Performers are independent contractors of their respective Tenants, not employees or agents of the Company. Age and identity verification of Performers is the sole responsibility of the Tenant.
1.4 "Viewer" means any individual who watches Content on the Platform, regardless of whether they register an account.
1.5 "Camera Slot" means an independent broadcast channel available to a Tenant on the Platform, each providing its own RTMP/WebRTC ingest, viewer page, chat functionality, and tipping features.
1.6 "Monetary Transaction" means any payment processed through the Platform, including Tips, virtual drink purchases, paid dance or song requests, paid messages, or any other viewer-to-bar or viewer-to-performer payment.
1.7 "Tip" means a voluntary monetary contribution made by a Viewer to a Performer or to a Tenant through the Platform.
1.8 "Content" means any livestream video, audio, images, text, messages, graphics, or other material transmitted, uploaded, streamed, or otherwise submitted through the Platform by any user.
1.9 "Prohibited Content" means any Content that falls within the categories set forth in Section 5 of these Terms.
1.10 "Personal Data" means any information relating to an identified or identifiable natural person, as defined under the Personal Data (Privacy) Ordinance, Cap. 486 of the Laws of Hong Kong ("PDPO") and, where applicable, under the Personal Data Protection Act B.E. 2562 (2019) of Thailand ("PDPA").
1.11 "Services" means the livestreaming, tipping, messaging, performer profile management, multi-camera studio, and other related services provided by the Company through the Platform, including access to Camera Slots as specified in the applicable plan.
1.12 "Subscription Plan" means the tier of Service selected by Tenant (Free Plan, Pro Plan, Enterprise Plan) which determines the number of Camera Slots included and any applicable fees.
1.13 "User" means any individual or entity accessing or using the Platform, including Tenants, Bar Admins, Performers, and Viewers.
Platform Services
2.1 BarStreamHub is a multi-tenant livestreaming SaaS platform that enables Tenants to: (a) create a branded livestreaming experience for their venue; (b) manage Performers and their individual profiles; (c) stream live entertainment Content to Viewers; (d) receive Tips and other Monetary Transactions from Viewers; (e) customise their branding, including logos, colors, and venue-specific settings; and (f) access a browser-based multi-camera studio for managing multiple independent Camera Slots simultaneously.
2.2 The Company acts as a technology service provider only. The Company does not control, monitor, or assume responsibility for: (a) the Content streamed by Tenants or Performers; (b) the acts or omissions of Tenants, Performers, or Viewers; (c) the compliance of Tenants or Performers with applicable laws and regulations; (d) the accuracy, completeness, or legality of any Content transmitted through the Platform.
2.3 The Company reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time. Reasonable advance notice shall be provided to affected Users where practicable, except in cases of emergency, security threat, or legal requirement where immediate action is necessary.
2.4 For Tenants operating in Thailand, the Company is a "social media platform operator" as defined under the Computer Crime Act B.E. 2550 (2007) and is subject to the legal obligations set forth therein, including the requirement to remove unlawful Content within twenty-four (24) hours of receiving notification from the Ministry of Digital Economy and Society (MDES) or other competent authority.
Account Registration and Eligibility
3.1 To register as a Tenant, you must: (a) be a legally registered business entity (or an individual operating as a sole proprietor, where permitted by law) in your jurisdiction of operation; (b) be at least twenty (20) years of age if you are an individual operating a business in Thailand, or the age of majority in your jurisdiction, whichever is higher; (c) provide accurate, complete, and current business information during registration, including your legal business name, business registration number, registered address, and valid contact information; and (d) obtain and maintain all necessary licences, permits, and authorisations required under applicable law to operate your establishment and to stream live entertainment Content.
3.2 To register as a Performer, you must: (a) be at least twenty (20) years of age (the legal minimum age for performers under Thai law); (b) provide accurate, complete, and current personal information; and (c) have been duly registered and authorised by the Tenant on whose behalf you will stream.
3.3 Viewers must be at least eighteen (18) years of age. By viewing Content on the Platform, you represent and warrant that you meet this age requirement.
3.4 All Users are solely responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You must notify the Company immediately at support@barstreamhub.com of any unauthorised use of your account or any other breach of security.
3.5 The Company reserves the right to refuse registration to any person or entity for any reason not prohibited by applicable law, and to suspend or terminate accounts that violate these Terms.
3.6 Users may not create multiple accounts for the purpose of circumventing these Terms or any suspension or termination of access. In the event of a violation of these Terms, the Company reserves the right to take appropriate legal action, including but not limited to referring the matter to law enforcement authorities for criminal proceedings, as provided under the Computer Crime Act B.E. 2550 (2007) of Thailand and other applicable laws.
Age Verification and Performer Identity (Tenant Obligations)
4.1 Tenants are solely and exclusively responsible for verifying the age and identity of each Performer prior to granting them access to the Platform.
4.2 Age verification must confirm that the Performer is at least twenty (20) years of age. Acceptable methods of verification include: (a) biometric age estimation using a digital identity verification service that complies with Thai ETDA guidelines (e.g., ThaID integration or equivalent); (b) government ID document scan with real-time liveness detection and facial matching; or (c) manual document review of a valid government-issued identification document (passport, Thai national ID card, or driving licence) accompanied by a contemporaneous selfie or live photograph.
4.3 Tenants shall maintain accurate records of all age verifications performed for a minimum period of two (2) years following the termination of the Performer's relationship with the Tenant, and shall provide such records to the Company upon reasonable request.
4.4 No individual under twenty (20) years of age may be registered as a Performer. Fabricating, altering, or submitting fraudulent identification documents constitutes a material breach of these Terms and may be reported to relevant law enforcement authorities under the Computer Crime Act B.E. 2550 (2007).
Prohibited Content and Acceptable Use
5.1 All Content transmitted through the Platform must comply with applicable laws of Thailand, Hong Kong, and any other relevant jurisdiction.
5.2 Content Prohibited under Thai Law: (a) false or misleading information that causes damage to the public or incites public panic, as prohibited under Section 14 of the Computer Crime Act B.E. 2550 (2007); (b) content that endangers national security, as determined by competent Thai authorities; (c) content deemed offensive to the Thai monarchy (lèse-majesté) under Section 112 of the Thai Criminal Code; (d) criminal defamation, as defined under the Thai Penal Code; (e) nudity, sexually explicit conduct, pornographic material, or any content depicting or suggesting sexual acts; (f) child sexual abuse material (CSAM), which must be removed immediately upon identification and reported to law enforcement authorities; (g) obscene content harmful to minors, as defined under the Thai Penal Code; (h) content promoting illegal activities, including gambling, unlicensed alcohol sales, drug use, or violence.
5.3 Content Prohibited under Hong Kong Law: (a) content that violates the National Security Law of Hong Kong, including material that constitutes separatism, subversion, terrorism, or collusion with foreign forces; (b) doxxing (the publication of personal data of target persons without consent), which is prohibited under the Personal Data (Privacy) Ordinance, Cap. 486; (c) content that infringes on intellectual property rights of third parties.
5.4 Conduct Prohibited on the Platform: (a) harassment, hate speech, bullying, threats, or abuse directed at any Performer, Tenant, Viewer, or Company representative; (b) spamming or unsolicited commercial messages; (c) attempting to circumvent any age-verification or content-filtering mechanisms; (d) using the Platform for any illegal purpose, including but not limited to money laundering, fraud, or human trafficking; (e) impersonating any person or entity; (f) recording, reproducing, distributing, or publicly performing any Content accessed through the Platform without express written permission; (g) attempting to hack, disrupt, overload, or otherwise interfere with the Platform's infrastructure.
5.5 Tenants and Performers are solely responsible for ensuring that all Content complies with applicable laws and these Terms. The Company reserves the right, but not the obligation, to monitor Content, and shall remove any Content that it reasonably believes violates these Terms or applicable law.
5.6 Takedown Obligation (Thailand-Specific): Under Section 14 of the Computer Crime Act B.E. 2550 (2007), the Company is required to remove Prohibited Content within twenty-four (24) hours of receiving a valid court order or MDES notification. The Company shall comply with all lawful takedown requests from Thai authorities and may terminate the accounts of Users who repeatedly violate this obligation.
5.7 Platform operators face criminal liability if they fail to remove content deemed illegal by authorities under Section 15 of the CCA. The Company shall maintain logs of all takedown actions, preserve evidence, and document compliance procedures for audit by the MDES or other competent authorities.
Subscription Plans, Camera Slots, and Fees
6.1 The Platform offers the following Subscription Plans:
- Free Plan — 4 Camera Slots included, $0 USD/month, 20% transaction commission
- Pro Plan — 10 Camera Slots included, $49 USD/month, 15% transaction commission
- Enterprise Plan — 20+ Camera Slots, custom pricing, negotiable commission
6.2 Additional Camera Slots may be purchased at a one-time setup fee of $75 USD per additional slot. No recurring subscription fee applies to additional slots.
6.3 The Free Plan is provided "as is" and "as available" without any service level commitments. The Company reserves the right to discontinue the Free Plan at any time upon thirty (30) days' notice.
6.4 The Transaction Commission is calculated on the gross amount of each Monetary Transaction before any payment processor fees are deducted. The Commission shall be deducted automatically at the time of each transaction.
6.5 The Company reserves the right to change its fee structure upon thirty (30) days' prior written notice to Tenants. Continued use of the Platform Services after the effective date of such change constitutes acceptance of the new fees.
6.6 All fees and commissions are exclusive of any applicable taxes, levies, duties, or similar governmental charges, including Hong Kong Profits Tax, Thai Value Added Tax (VAT), or withholding taxes. Tenants shall be solely responsible for payment of all such taxes, except those based on the Company's net income.
Monetary Transaction Processing and Payouts
7.1 The Company facilitates Monetary Transaction collection and payout distribution through Stripe, Inc.
7.2 Tenants and Performers acknowledge and agree to enter into a direct contractual relationship with Stripe by accepting the Stripe Connected Account Agreement. The Company is not a party to any agreement between a User and the payment processor.
7.3 The following amounts are deducted from each Monetary Transaction before any payout is made: (a) payment processor fees deducted by Stripe (currently approximately 2.9% + $0.30 per transaction plus any applicable payout fees); (b) Transaction Commission deducted by the Company as set forth in Section 6.
7.4 Following the deductions set forth in Section 7.3, the remaining balance is transferred to Stripe accounts designated by the Tenant and each Performer according to the payout configuration selected by the Tenant in the dashboard.
7.5 Each Tenant is solely responsible for: (a) determining the payout split between itself and its Performers; (b) making accurate and timely payouts to Performers; (c) all tax reporting obligations arising from such payouts; (d) compliance with all applicable anti-money laundering ("AML") and counter-terrorist financing ("CTF") laws and regulations; and (e) providing accurate banking and payout information to the payment processor.
7.6 Performers are solely responsible for their own tax reporting obligations arising from Tips and other Monetary Transactions received through the Platform.
7.7 The Company shall not be liable for any acts or omissions of Stripe or any other third-party payment processor. Any disputes regarding payment processor fees, chargebacks, or account freezes shall be resolved directly between the User and the payment processor.
7.8 All Tips and Monetary Transactions are final and non-refundable, except where required by applicable law. Viewers acknowledge that Tips are voluntary gratuities and no goods or services are exchanged for Tips. The Company reserves the right to reverse or refund a transaction if it reasonably determines that the transaction was fraudulent, unauthorised, or otherwise in violation of these Terms.
Intellectual Property Rights
8.1 As between the Company and any User, the Company retains all right, title, and interest in and to the Platform Services, including all software, algorithms, source code, trademarks, trade secrets, and documentation.
8.2 Users retain ownership of any Content they upload, post, or stream through the Platform.
8.3 By streaming or uploading Content to the Platform, each User hereby grants the Company a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, cache, transmit, display, perform, and reproduce the Content solely as necessary to provide the Services, to improve the Platform, and to comply with applicable legal obligations.
8.4 Tenants and Performers represent and warrant that they have obtained all necessary rights, licences, consents, and permissions for any music or other copyrighted material included in their Content. A failure to secure proper music licensing may constitute a material breach of these Terms.
8.5 If you believe that your copyright has been infringed through the Platform, please provide written notice to legal@barstreamhub.com.
Data Privacy and Personal Data Protection
9.1 The Company is committed to protecting the privacy and Personal Data of all Users in accordance with: (a) the Personal Data (Privacy) Ordinance, Cap. 486 of the Laws of Hong Kong ("PDPO"); (b) where Users are located in Thailand, the Personal Data Protection Act B.E. 2562 (2019) ("PDPA"); and (c) the Company's Privacy Policy, available at https://barstreamhub.com/privacy.
9.2 The Company acts as a "data user" under the PDPO and shall comply with the six Data Protection Principles set forth in Schedule 1 of the PDPO, covering: lawful collection, data accuracy and retention, purpose limitation, security, openness, and data access and correction rights.
9.3 For Users located in Thailand, the Company shall comply with the PDPA's requirements for data controllers, including obtaining explicit consent, providing data subject rights, implementing appropriate security measures, and notifying data subjects and the PDPC within seventy-two (72) hours of a personal data breach.
9.4 The Company collects and processes the following categories of Personal Data: registration data, transaction data, technical data, and communication data.
9.5 Retention periods are as follows: viewers' account data — duration of account plus 36 months; performers' verification records — duration of performer relationship plus 24 months; payment transaction data — 7 years; stream logs and metadata — 12 months; chat message content — 6 months.
9.6 Data subjects may request access to, correction of, or deletion of their Personal Data by submitting a written request to privacy@barstreamhub.com. The Company shall respond within forty (40) days of receipt.
9.7 For Thailand Users, personal data may be transferred from Thailand to another country only when the transfer falls within one of three legal pathways: (i) the destination country has been recognised as providing adequate protection; (ii) a derogation applies (e.g., explicit consent, contractual necessity, or legal obligations); or (iii) appropriate safeguards such as Standard Contractual Clauses are implemented.
9.8 In the event of a personal data breach, the Company shall take immediate steps to contain and investigate the breach, notify affected Users and relevant authorities within the timeframes prescribed by applicable law, and document all remedial actions taken.
Representations and Warranties
10.1 The Company represents and warrants that the Platform Services will perform materially in accordance with the service level specifications set forth in Section 12.
10.2 Each User represents and warrants that: (a) they have all necessary rights, licences, consents, and permits to use the Platform Services in compliance with all applicable laws; (b) their use of the Platform Services and their Content will not violate any applicable law, including the CCA, PDPO, and PDPA; (c) each Performer is at least twenty (20) years of age (for Users operating in Thailand); (d) they have obtained valid written consent from each Performer for the collection, use, and processing of their Personal Data; (e) they shall not submit any Prohibited Content through the Platform Services; (f) their Content does not infringe the intellectual property rights of any third party; and (g) they shall comply with all content moderation and takedown obligations.
10.3 DISCLAIMER OF WARRANTIES. EXCEPT AS EXPRESSLY SET FORTH IN SECTION 10.1, THE PLATFORM SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Indemnification
11.1 Tenants and Performers shall indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) their Content; (b) their use of the Platform Services; (c) violation of these Terms; (d) violation of any applicable law; (e) any dispute between them and any other User or third party; (f) failure to remove Prohibited Content; (g) any misrepresentation or breach of warranty; (h) failure to perform proper age verification.
11.2 Viewers shall indemnify, defend, and hold harmless the Company from and against any claims arising out of or relating to: (a) their violation of these Terms or any applicable law; (b) any fraudulent or unauthorised use of payment methods; (c) harassment or abuse directed at any Performer, Tenant, or the Company's personnel.
11.3 The indemnified party shall give the indemnifying party prompt written notice of any claim, permit the indemnifying party to assume sole control of the defence, and cooperate fully with the indemnifying party in asserting any available defences.
Service Availability, Performance, and Support
12.1 Service Level Targets (paid Subscription Plans):
- Uptime: 99.9% monthly (excluding scheduled maintenance)
- Stream Latency: < 1 second (WebRTC end-to-end)
- Support Response: 24 hours (business days)
- Scheduled Maintenance: weekly windows, notified at least 48 hours in advance
12.2 The Free Plan is provided without any service level commitments.
12.3 The Company may perform scheduled maintenance during weekly maintenance windows with at least forty-eight (48) hours' advance notice where practicable.
12.4 Neither party shall be liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, war, terrorism, pandemics, or any failure of third-party service providers.
12.5 Technical support is available via email at support@barstreamhub.com during business hours (Monday to Friday, 9:00 AM to 6:00 PM Hong Kong Time).
Limitation of Liability
13.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
13.2 THE COMPANY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (a) THE TOTAL FEES PAID BY THE TENANT TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (b) ONE HUNDRED UNITED STATES DOLLARS (US$100.00). For Viewers and Performers who have paid no fees to the Company, the Company's total aggregate liability shall not exceed US$50.00.
13.3 NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT THE COMPANY'S LIABILITY FOR: (a) death or personal injury caused by the Company's negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be excluded or limited under applicable law.
13.4 If you are a consumer in Thailand, nothing in these Terms affects your statutory rights under Thai consumer protection laws, including the Consumer Protection Act B.E. 2522 (1979).
Term, Suspension, and Termination
14.1 These Terms commence on the date a User first accesses or uses the Platform and continue until terminated.
14.2 Tenants may terminate their account at any time by contacting support@barstreamhub.com. Upon termination, the Tenant's access ceases at the end of the then-current billing period (for paid plans) or immediately (for the Free Plan). No refunds shall be provided for any prepaid fees.
14.3 Performers and Viewers may terminate their accounts by following the account deletion process within the Platform dashboard or by contacting support@barstreamhub.com.
14.4 The Company may suspend or terminate a User's access immediately upon written notice if: (a) the User breaches any provision of these Terms; (b) the Company reasonably believes the User's use poses a security risk; (c) the User fails to pay any fees when due; (d) the Company is required to do so by law or governmental authority; (e) the User becomes insolvent or ceases to operate; or (f) the User engages in conduct harmful to the Company, other Users, or the public.
14.5 Upon termination: all rights granted to the User cease immediately; the Company shall delete or anonymise the User's Personal Data in accordance with applicable law; the User shall pay any outstanding fees; and Sections 1, 8, 9, 10.3, 11, 13, 14.5, 15, 16, and 17 shall survive termination.
14.6 Upon termination, Tenants on paid Subscription Plans may request a one-time export of their data within fourteen (14) days of termination. Tenants on the Free Plan are not entitled to data export.
Confidentiality
15.1 Each party agrees to keep confidential all Confidential Information of the other party and shall not use or disclose such Confidential Information except as necessary to perform its obligations under these Terms or as required by law.
15.2 "Confidential Information" means all non-public information disclosed by either party, including the Company's software architecture, source code, algorithms, pricing, and proprietary technology; Tenant's business data, performer information, customer lists, and financial information; and any information designated as confidential or that a reasonable person would understand to be confidential.
15.3 Confidential Information does not include information that: is or becomes generally available to the public other than through a breach of these Terms; was rightfully in the receiving party's possession without confidentiality obligations prior to disclosure; or is independently developed by the receiving party without use of the disclosing party's Confidential Information.
15.4 The obligations of confidentiality shall survive termination of these Terms for a period of five (5) years.
Governing Law and Dispute Resolution
16.1 These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of laws principles.
16.2 Tenants, Performers, and Viewers operating in or accessing the Platform from Thailand acknowledge that their use of the Platform is additionally subject to the mandatory laws of the Kingdom of Thailand, including the CCA and PDPA, and that criminal liability under the CCA overrides nationality.
16.3 Dispute Resolution Process: (a) Good Faith Negotiation — parties shall first attempt to resolve the dispute through good-faith negotiations for a period of thirty (30) days; (b) Mediation — if unresolved, either party may refer the dispute to mediation administered by the HKIAC or, for disputes involving Thai Users, the Thailand Arbitration Centre (THAC); (c) Arbitration — if mediation fails within sixty (60) days, either party may submit the dispute to binding arbitration administered by the HKIAC under the HKIAC Administered Arbitration Rules, with the seat of arbitration in Hong Kong, conducted in English before a single arbitrator.
16.4 Notwithstanding the dispute resolution provisions, the Company may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its Intellectual Property Rights or prevent irreparable harm.
16.5 If you are a consumer in Thailand, you retain all rights under the Consumer Protection Act B.E. 2522 (1979) and may file complaints with the Office of the Consumer Protection Board (OCPB).
16.6 To the maximum extent permitted by applicable law, all disputes must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class action.
General Provisions
17.1 These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the User and the Company regarding the User's use of the Platform.
17.2 The Company may amend these Terms at any time. Material changes shall be communicated to registered Users via email or through a prominent notice on the Platform at least thirty (30) days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the amended Terms.
17.3 No failure or delay by the Company in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof.
17.4 If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
17.5 Users may not assign or transfer these Terms without the prior written consent of the Company. The Company may assign these Terms without restriction to any successor in interest.
17.6 All notices under these Terms shall be in writing and shall be deemed given when delivered personally, sent by confirmed email, or sent by registered mail to the addresses set forth in the registration information.
17.7 Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between any User and the Company. Performers are independent contractors of their respective Tenants, not employees or agents of the Company.
17.8 These Terms are drafted in the English language. Any translation provided for convenience shall not prevail over the English version in the event of any conflict or inconsistency.
